Helms-Burton: Government clarifies how to deal with notifications of claims for companies

Andersen Tax & Legal participates in the Government's meeting with companies and legal advisors to report on the European Union's Blockade Statute that protects Spanish companies from lawsuits in the US based on Helms-Burton, according to Voz Populi

Spanish companies breathe easy at Helms-Burton's expense. At least for now. The government has conveyed that the European Union's Blocking Statute allows notifications sent from American courts based on Helms-Burton to be blocked to companies and their legal advisors.

In August, the government invited the business sector together with important firms that advise on Cuban law, such as Andersen Tax & Legal, to a meeting with members of Foreign Affairs, Justice and Trade to make a first analysis of the scenarios that the authorities were handling. After this first meeting, the Executive has informed the companies that any notification will be rejected as it is considered a violation of national sovereignty. Acceptance of these notifications would be a violation of the rules and the courts will be informed of how to proceed.

In any case, it should be noted that the Government does not have the power to decide whether to apply a European regulation. The statute has always been in force but the doubt that existed is whether it prevailed over the convention or not. However, this is the first time that it will be applied, so what happens from now on is an unknown for companies, authorities and plaintiffs.
