The High Court of Justice of the Balearic Islands has declared the dismissal of a bus driver who tested positive for cannabis in the drug test unfair after an accident in which a motorist died. The ruling of March 22, 2019 concludes the simple fact of giving a positive test result doesn’t prove driving under the effects of cannabis, "unlike what happens with alcohol”.

Alfredo Aspra, partner in the Labour Department of Andersen Tax & Legal, points out that this ruling is "not wasted". The lawyer points out that "the Court understands that since neither the co-worker nor the police officers detected any strange behaviour in the plaintiff, he could have taken it in his free time.
